1. General Information
Welcome to https://shop.elvaquero.it (the “Site”), the official online shop of Valerio Giuntoli Corporation S.r.l.

Products offered for sale on https://shop.elvaquero.it are sold and invoiced by Valerio Giuntoli Corporation S.r.l. (Tax Code and VAT No. 01798100473), with registered office in Monsummano Terme (PT), Via Francesca Nord no. 144/a, Italy.

2. Acceptance of the General Terms of Sale and Conclusion of the Contract
The contract entered into between Valerio Giuntoli Corporation S.r.l. (hereinafter “VGC”) and the Customer (i.e., a natural person who makes a purchase on the Site for purposes not related to their business, entrepreneurial or professional activity) shall be deemed concluded upon VGC’s acceptance, even partial, of the order. “Partial acceptance” means the case where, within a single order including multiple products, VGC accepts only the purchase request for some of the products included in that order. In the event of non-acceptance of the order, VGC shall in any case promptly inform the Customer.

By placing an order in the various available ways, through the order form on the Site (hereinafter the “Order”), the Customer declares that they have read all information provided during the purchase procedure and fully accept these general terms and conditions (hereinafter the “Terms”). These Terms may be printed or saved on a durable medium, in accordance with Article 12 of Legislative Decree 70/2003 and Article 51 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014.

3. Purchase Procedure
The products offered for sale by VGC are exclusively those displayed on https://shop.elvaquero.it at the time the Order is submitted, as described in the relevant product information sheets.

In any case, images accompanying the product description are for information purposes only and may not perfectly represent the product’s characteristics and may differ, for example, in color, shape and size (also depending on the browser and monitor used to access the Site and view images).

To place an Order, the Customer must, after carefully reviewing these Terms, complete the relevant form on the Site in all its parts and submit it, together with the characteristics of the product(s) they intend to purchase. The fiscal invoice will be downloadable in the Customer’s personal area on https://shop.elvaquero.it, in the section relating to the relevant order.

Receipt of the Order is confirmed by VGC via an email reply (which the parties consider a valid means of communication) sent to the email address provided by the Customer. This confirmation message will summarize the purchase conditions, as required by applicable law, as well as the data entered by the Customer in the Order, so that the Customer may verify them and, if necessary, communicate without delay and in any event within 24 hours from the sending of said email, any corrections to incorrect data. If no communication is received within this term, the parties agree that VGC shall consider the Order fully and tacitly confirmed by the Customer in all respects.

4. Prices and Payment Methods
Prices shown on the Site are inclusive of taxes and VAT. Any shipping costs or payment fees are in any case communicated to the Customer in advance through the Site on the order summary page or in these Terms and will be specified in the order confirmation email.

The following payment methods are available:

4.1 PayPal
The Customer may use PayPal according to PayPal’s specific procedures.

4.2 Credit card
In the case of purchase by credit card, the transaction may be processed via PayPal, Stripe or another secure server selected by VGC. At no time and at no stage of the payment process will VGC be able to know the Customer’s credit card details, which are transmitted through a protected connection directly to the banking institution managing the transaction. VGC will not collect such data and no VGC IT archive will store it; therefore, in no case may VGC be held liable for any fraudulent or improper use of credit cards by third parties at the time of payment.

5. Delivery of Products and Related Costs
Purchased products will be delivered to the address specified by the Customer in the Order within 48–72 hours from VGC’s acceptance of the Order, at the cost specifically indicated on the Site before submission of the Order. VGC reserves the right to accept or refuse delivery requests outside Italy or Europe. In any case, for deliveries to be carried out outside Italy, shipping costs and delivery times may vary.

For deliveries to countries outside the European Union, any import customs duties shall be borne by the recipient. Customers are therefore invited to contact their local customs authority in advance to check costs and any import restrictions.

The delivery times indicated by VGC are purely indicative and any delay, or any delivery made through subsequent split shipments, shall not entitle the Customer to refuse delivery or to claim compensation or damages.

Upon delivery, the Customer must check:

  • that the number of packages delivered corresponds to what is indicated in the transport document;

  • that the packaging is intact, not damaged, wet or otherwise altered, including sealing materials (adhesive tape or metal straps).

Any damage to the packaging and/or the product, or any mismatch in the number of packages or the information provided, must be immediately reported by adding a specific note on the delivery document to be returned to the courier.

Any issues regarding the physical integrity, correspondence or completeness of the products received must be reported within 7 days from delivery, according to the procedures set out in this document.

6. Promotional Offers and Complimentary Gifts (Domus Aura)
When active and published on the Site, VGC may offer promotional initiatives that provide complimentary gifts or product bundles under preferential terms (the “Promotions”). Unless otherwise stated on the Site:

  • Promotions are valid exclusively for online purchases on the Site;

  • Promotions are valid while stocks last and/or within the limits indicated for each Promotion;

  • complimentary gifts cannot be converted into cash, nor replaced except in case of unavailability (in which case VGC may offer a gift of comparable value and characteristics);

  • unless otherwise stated on the Site, Promotions cannot be combined: if an Order meets the requirements of more than one Promotion, only one Promotion will apply, generally the one most favorable to the Customer; in particular, among those listed below, the “Signature Look” Promotion shall prevail (where applicable) over the “Aura Set” Promotion.

For the purpose of assessing spending thresholds, only the total value of products included in the Order is considered (therefore excluding shipping costs and any ancillary charges), as shown in the cart/Order summary. Where the Site allows display and/or payment in US dollars (USD), reference values in USD are also provided for the Customer’s convenience; in case of discrepancies, the currency and amount shown at checkout at the time of the Order shall prevail.

6.1 Promo 1 — Domus Aura “Founders Gift” (Early Bird) (reference value: 600 USD)

6.3 Promo 3 — Domus Aura “Signature Look” (threshold €1500 / 2000 USD)
Benefit: complete look (pashmina/scarf + bag + dress + Boho/Cowgirl hat).
Eligibility: Order product total ≥ €1500 (or ≥ 2000 USD, where applicable based on the currency selected at checkout).
Presentation: “Insider treatment: the full look, curated like private styling.”

6.4 Returns/Withdrawal and Promotions (loss of the offer)
For Orders including complimentary gifts or promotional benefits, the Customer acknowledges that:

  • if the Customer returns/withdraws even a single item included in the Order that granted access to the Promotion (or, more generally, if following the return/withdrawal the requirements of the Promotion are no longer met, including any spending threshold), the Customer automatically loses the Promotion (“withdrawal from the offer”);

  • in such case, the Customer must also return all complimentary gifts (and/or items included on a promotional basis), together with the other returned items, in accordance with these Terms;

  • if the Customer does not wish to return the complimentary gifts, they may keep them by paying their full price: in such case VGC will charge the Customer the full retail price of the gifts (as displayed on the Site at the time of the Order, unless otherwise stated), including by offset/deduction from the refund due, or, if necessary, by requesting payment as communicated to the Customer.

VGC reserves the right to provide operational instructions for returning complimentary gifts and/or for payment of the same, consistent with the above.

7. Right of Withdrawal
Pursuant to Article 52 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014, the Customer may withdraw from these Terms and therefore from the purchase contract for any reason, without having to provide explanations and without penalty, within 14 (fourteen) business days from the date of receipt of the products.

To exercise the right of withdrawal referred to above, the Customer must send a notice to VGC within the indicated time limits to the following email address: customercare@elvaquero.it, and wait for explicit authorization to proceed.

In case of withdrawal, after receiving authorization from VGC, the Customer must return the products at their own expense to VGC within 14 (fourteen) days from the withdrawal, to the following address:

The goods must be returned intact, complete with all parts and in the original packaging (bags and boxes), stored and, if used, only to the extent strictly necessary to establish and verify their nature, characteristics and size, with ordinary care, with no signs of wear or dirt, in accordance with the conditions below:

  • the right of withdrawal applies to the purchased product in its entirety; it is not possible to withdraw only from part of the purchased product (e.g., accessories, complements, etc.);

  • for withdrawal to be possible, the product must be intact and returned in the original packaging, complete in all its parts (including packaging and any documentation and accessories: labels, tags, seals, etc.);

  • the shipment, until proof of receipt at the warehouse indicated by VGC, is under the Customer’s full responsibility;

  • in the event of damage during transport, VGC will inform the Customer to allow them to promptly file a claim against the courier chosen by the Customer and obtain reimbursement; the product will then be made available to the Customer, simultaneously canceling the withdrawal request;

  • VGC shall not be liable in any way for damage, theft or loss occurring during or in connection with the return shipment.

VGC will refund the Customer the entire amount already paid within 14 (fourteen) days from withdrawal, by reversing the charge, using the same payment method used by the Customer for the initial transaction, unless otherwise agreed. In any case, the Customer will not incur any costs as a consequence of such refund. VGC may withhold the refund until it has received the returned products or until the Customer has provided evidence of having returned the products, whichever occurs first.

In any case, the Customer shall lose the right of withdrawal if VGC ascertains that:

  • the returned product and/or its accessories and/or its packaging are not intact;

  • the product is missing its external packaging and/or original internal packaging;

  • the product is missing integral components and/or accessories (e.g., closures, laces, buckles, etc.).

In case of loss of the right of withdrawal, VGC will return the purchased product to the sender, charging shipping costs and, if already refunded, the price of the product.

8. Warranty
All products sold by VGC are covered by a 24 (twenty-four) month warranty from the date shown on the purchase document for conformity defects, pursuant to Title III of Legislative Decree 206/2005. To obtain warranty service, the Customer must keep the invoice or payment receipt together with the transport document.

The warranty for conformity defects applies provided that the product has been used correctly, in accordance with its intended use and the instructions for use and washing included in and/or with the product.

If, for any reason, VGC is unable to repair or replace a product under warranty, or where repair or replacement would be excessively burdensome (also in view of the product’s value), VGC may provide an appropriate price reduction or refund the full amount paid with termination of the contract, depending on the state of wear of the product assessed at VGC’s discretion.

Where warranty service requires return of the product, it must be returned by the Customer in its original packaging, complete in all its parts (including any packaging and documentation/accessories).

10. Privacy
Personal data collected through submission of the Order will be processed (collected and stored) by VGC solely for the purpose of fulfilling the Customer’s explicit requests, in compliance with Regulation (EU) 2016/679 and the privacy notice available on the Site. Any further processing will be carried out only with the Customer’s express consent.

11. Governing Law
The sales contract under these Terms and its performance are governed by Italian law, excluding conflict of laws rules and the United Nations Convention on Contracts for the International Sale of Goods. For any dispute, the competent court shall be the court of the Customer’s place of residence.

12. Copyright
Trademarks, logos and other distinctive signs on the Site belong to their respective owners. The use of trademarks, logos and other distinctive signs, including reproduction on other websites by unauthorized third parties, is prohibited. The contents of the Site are protected by copyright (texts, images and graphics).

13. Entire Agreement
This contract replaces all previous contracts, agreements and understandings between the parties and constitutes the entire agreement regarding its subject matter, together with the Order, the general terms relating to use of the Site and the terms relating to the registration service. Any variation or amendment must be accepted in writing by both parties.

14. Communications
All communications between the parties must be made in writing and sent to the address of the other party indicated in the contract and in the Order. Communications sent to the other party’s email address, indicated on the Site and in the Order, shall also be deemed to be in writing.

Communications relating to the validity or existence of this agreement must be delivered by hand or sent by registered letter with return receipt or by certified email (PEC).

15. Language
The sales contract is drafted in two versions: Italian and English.

In case of discrepancies between the two languages, the Italian version shall prevail.
