GENERAL CONDITIONS OF SALE

The products available for purchase on https://shop.elvaquero.it are sold and invoiced by Valerio Giuntoli Corporation S.r.l. (Tax Code and VAT Number 01798100473), with its registered office located at Via Francesca Nord No. 144/a, Monsummano Terme (PT), Italy.

Acceptance of General Terms and Conclusion of the Contract

The contract between Valerio Giuntoli Corporation S.r.l. (hereinafter "VGC") and the Customer (a natural person making a purchase on the Site for personal use, not for commercial, entrepreneurial, or professional purposes) is considered concluded upon acceptance of the order by VGC, even if only partially. Partial acceptance applies when an order containing multiple products is only partially fulfilled by VGC. If an order is not accepted, VGC will promptly inform the Customer.

By placing an order through the available means on the Site (the "Order"), the Customer confirms that they have read all relevant information provided during the purchasing process and fully accept these General Conditions (the "Conditions"). These Conditions can be printed or saved on a durable medium, in accordance with Article 12 of Italian Legislative Decree 70/2003 and Article 51 of Italian Legislative Decree 206/2005, as amended by Legislative Decree 21/2014.

 

Purchasing Process

The products available for purchase from VGC are exclusively those displayed on the Site at the time of the Order, as described in their respective product pages.

Please note that the images accompanying product descriptions are for illustrative purposes only and may not perfectly represent the actual product characteristics, such as color, shape, and size, due to variations in browser settings and monitor display.

To place an Order, the Customer must carefully review these Conditions, complete the order form in full, and submit it along with the product details.

Upon receipt of an Order, VGC will confirm its acceptance via email, which serves as a valid form of communication. This confirmation email will summarize the purchase details, as required by applicable law, along with the information entered by the Customer in the Order. The Customer must review the details and notify VGC immediately of any corrections, no later than 24 hours after receiving the email. If no corrections are communicated within this period, the Order will be deemed fully and tacitly confirmed.

 

Prices and Payment Methods

The prices displayed on the Site are inclusive of all applicable taxes and VAT. Any additional shipping costs or payment fees will be communicated in advance through the Site on the order summary page and will also be specified in the order confirmation email.

The following payment methods are accepted:

• PayPal: Customers may pay using PayPal in accordance with its specific terms and conditions.
• Credit Card: Payments by credit card are processed securely through PayPal, Stripe, or another secure payment gateway chosen by VGC. At no point does VGC have access to the Customer’s credit card details, as these are transmitted securely and directly to the payment processor. VGC does not store or retain any credit card information and cannot be held liable for fraudulent or improper use of credit card details by third parties.
• Scalapay: A payment method that allows the total amount to be split into three monthly installments. Scalapay reserves the right to accept or decline the order based on its internal criteria, which VGC is not privy to. Scalapay’s availability depends on the Customer’s country and will be displayed at checkout.

 

Product Delivery and Related Costs

Products purchased will be delivered to the address provided by the Customer in the Order within 48–72 hours from the acceptance of the Order by VGC, at the shipping cost specifically indicated on the Website prior to order submission.

VGC reserves the right to accept or decline orders for delivery outside of Italy or the European Union. In any case, for deliveries outside of Italy, shipping costs and delivery times may vary.

For deliveries to countries outside the European Union, any customs import fees will be the responsibility of the recipient. We therefore recommend that the Customer contact their local customs office in advance to verify applicable costs and any import restrictions.

Delivery times indicated by VGC are approximate. Any delays, or deliveries made in multiple shipments, do not entitle the Customer to refuse the delivery or to claim compensation or damages.

Upon delivery, the Customer is required to check:

• that the number of packages delivered matches what is stated on the shipping document;
• that the packaging is intact, undamaged, not wet or otherwise altered, including the sealing materials (adhesive tape or metal strapping).

Any damage to the packaging and/or product, or discrepancies in the number of packages or documentation, must be immediately noted on the delivery document and returned to the courier.

Any issues concerning the physical condition, conformity, or completeness of the products received must be reported within 7 days of delivery, according to the instructions provided in this document.

 

Right of Withdrawal

Pursuant to Article 52 of Italian Legislative Decree 206/2005, as amended by Legislative Decree 21/2014, the Customer has the right to withdraw from these Conditions and therefore from the purchase contract, for any reason, without providing justification and without incurring penalties, within 14 (fourteen) business days from the date of receipt of the products.

To exercise this right, the Customer must send a written notice to VGC within the specified period, by email to customercare@elvaquero.it or by using the appropriate form available on the Website. The Customer must wait for explicit authorization before proceeding with the return.

Once the return has been authorized by VGC, the Customer must send the products back at their own expense within 14 (fourteen) days from the date of withdrawal to the following address:

Products must be returned undamaged, complete with all components and in their original packaging (bags, boxes, etc.). They must be stored and possibly tried on only to determine their nature, characteristics, and fit — without signs of wear or dirt — and in accordance with the conditions outlined below:

• The right of withdrawal applies to the product in its entirety; it is not possible to return only part of the item purchased (e.g., accessories or components);
• For the return to be valid, the product must be intact and returned in its original packaging, complete with all parts (including packaging materials, documentation, and accessories: tags, seals, labels, etc.);
• The return shipment is the full responsibility of the Customer until receipt is confirmed at the warehouse designated by VGC;
• In case of damage during return shipping, VGC will notify the Customer so that they may file a claim with the courier used. In such cases, the product will be made available to the Customer, and the withdrawal request will be cancelled;
• VGC will not be held responsible in any way for loss, theft, or damage occurring during or due to the return shipment.

VGC will refund the full amount paid by the Customer within 14 (fourteen) days of receiving the withdrawal notice, using the same payment method originally used by the Customer, unless otherwise agreed. The refund may be withheld until the returned product has been received or until the Customer provides proof of shipment, whichever comes first.

 

Loss of the Right of Withdrawal

The Customer will lose the right of withdrawal if VGC finds that:

• The returned product and/or its accessories and/or packaging are not intact;
• The product is missing its outer packaging and/or original inner packaging;
• The product is missing essential elements and/or accessories (e.g., closures, laces, buckles, etc.).

In such cases, VGC will return the product to the Customer and charge the shipping costs. If a refund has already been issued, VGC reserves the right to reclaim the refunded amount.

 

Warranty

All products sold by VGC are covered by a 24-month warranty from the date of purchase, in accordance with Title III of Italian Legislative Decree 206/2005, for defects in conformity.

To benefit from the warranty, the Customer must retain the invoice, payment receipt, and shipping document.

The warranty applies only if the product has been used correctly, in accordance with its intended purpose and care instructions provided with or on the product.

If VGC is unable to repair or replace a defective product, or if the cost of such actions is disproportionately high compared to the product's value, VGC may offer an appropriate price reduction or a full refund, depending on the condition of the product, as assessed by VGC at its sole discretion.

If a warranty claim requires the return of the product, the item must be returned in its original packaging, complete with all parts (including packaging, documentation, and accessories).

Privacy

The personal data collected during the Order process will be processed by VGC solely for the purpose of fulfilling the Customer’s request, in compliance with EU Regulation 2016/679 (GDPR) and VGC’s privacy policy. Any further processing of personal data will occur only with the Customer’s explicit consent.

 

Applicable Law

The sales contract governed by these Conditions is subject to Italian law. The United Nations Convention on Contracts for the International Sale of Goods (CISG) and its conflict of law provisions shall not apply. Any disputes arising in connection with this contract shall be subject to the jurisdiction of the court of the Customer’s place of residence.

 

Copyright

All trademarks, logos, and other distinctive signs displayed on the Site are the property of their respective owners. The use of trademarks, logos, and other distinctive signs, including reproduction on third-party websites without authorization, is strictly prohibited. All content on the Site, including text, images, and graphics, is protected by copyright.

 

Entire Agreement

This contract supersedes all prior agreements, understandings, and representations between the parties and constitutes the entire agreement regarding the subject matter. It includes the order, the Site’s general terms of use, and the registration service conditions. Any amendments or modifications to this contract must be agreed upon in writing by both parties.

 

Communications

All communications between the parties must be in writing and sent to the address provided in the contract or Order. Communications sent to the email address provided in the Order or displayed on the Site shall also be deemed valid.

Communications concerning the validity or existence of this contract must be delivered in person, sent by registered mail with return receipt, or via Certified Electronic Mail (PEC).

 

Language

This sales contract is drafted in both Italian and English. In case of discrepancies, the Italian version shall prevail over the English translation.
